As of September 2004, there were 2 drug courts either being planned or already operating in West Virginia. One drug court had been in existence for over 2 years and another was being planned.

During 2002, 55.7% of Federally-sentenced defendants in West Virginia had committed drug offenses. Approximately 60% of the drug offenses involved crack cocaine. Powder and crack cocaine are widely available in most West Virginia cities. Abuse of crack is usually restricted to low and low-middle income individuals, but crosses all ethnic lines.

During 2003, the Drug Enforcement Administration (DEA) reported 70 arrests for drug violations in West Virginia. There were 2,060 state and local arrests for drug abuse violations in West Virginia during 2003.

During 2002, the West Virginia Division of Criminal Justice Services funded 1 statewide and 15 regional Drug and Violent Crime Control task forces. These task forces made 983 arrests for drug-related activity in 2002. The arrests resulted in 1,465 offenses charged to adults and 22 offenses charged to juveniles (some arrests involved more than one offense).
