As of March 24, 2005, there were 9 drug courts in existence or being planned in South Dakota. Two drug courts had been operating for more than 2 years, 2 were recently implemented, and 5 were being planned at that time.

During 2002, approximately 16.9% of the Federally-sentenced defendants in South Dakota had committed drug offenses. More than half of the drug cases involved methamphetamine. This increased use and demand for methamphetamine has continued to rise over the past year. Mexican methamphetamine is increasingly available in South Dakota. During 2004, authorities reported that there were 8 children affected by methamphetamine laboratories in South Dakota.

During 2004, the Drug Enforcement Administration (DEA) reported making 117 arrests for drug violations in South Dakota. There were 2,272 adult arrests for drug possession in South Dakota during 2003.

As of April 30, 2005, there were 3,300 adult inmates under correctional supervision in South Dakota. At this time, 407 of the inmates were incarcerated for possession of a controlled substance.
