As of March 2005, there were 138 drug courts in existence in California and another 18 in the planning stages.

In 2002 nearly 32 percent of the Federally-sentenced defendants in California were charged with a drug offense. More than 58 percent of the offenses involved marijuana.

There were 134,924 adult felony arrests and 5,820 juvenile felony arrests for drug offenses in California during 2003. There were 35,130 adult misdemeanor arrests and 13,051 juvenile misdemeanor arrests for marijuana offenses in California during 2003. The Drug Enforcement Administration (DEA) reported 2,794 drug arrests in California in 2004.

On November 7, 2000, California voters approved Proposition 36, the Substance Abuse and Crime Prevention Act of 2000. Under the Act, certain non-violent adult offenders who use or possess illegal drugs receive drug treatment in the community rather than incarceration. Proposition 36 is currently being studied and statistics are being compiled on the effectiveness of treatment instead of incarceration for nonviolent drug offenders.
